Indictments 2/19/21

The following indictments were returned by the Grand Jury of the Carter Circuit Court on February 19. An indictment is not a determination of guilt or innocence. It is simply a charge that an offense has been committed and indicates that a case is pending on the charges listed. All defendants have the presumption of innocence until found guilty in a court of law. 

Though it is a part of the public record, the Carter County Times does not make a habit of printing the names of minor children or the victims of alleged crimes, except under exceptional circumstances. 

  • Brenda Clevenger, 62, of Grayson, on or about December 12, 2020, the defendant committed the offense of complicity to capital murder, by soliciting, commanding, or engaging in a conspiracy with another person to commit the offense, or aiding, counseling, or attempting to aid another person in the offense of the capital murder of John Waggoner, a Capital Offense.
  • William Smith, 43, of Morehead, on or about December 12, 2020, the defendant committed the offense of complicity to capital murder, by soliciting, commanding, or engaging in a conspiracy with another person to commit the offense, or aiding, counseling, or attempting to aid another person in the offense of the capital murder of John Waggoner, a Capital Offense.
  • Jacob Ruth, 42, of Grayson, on or about December 12, 2020, the defendant committed the offense of complicity to capital murder, by soliciting, commanding, or engaging in a conspiracy with another person to commit the offense, or aiding, counseling, or attempting to aid another person in the offense of the capital murder of John Waggoner, a Capital Offense.
  • Roger Ratcliff, 70, of Grayson, on or about December 12, 2020, the defendant committed the offense of complicity to capital murder, by soliciting, commanding, or engaging in a conspiracy with another person to commit the offense, or aiding, counseling, or attempting to aid another person in the offense of the capital murder of John Waggoner, a Capital Offense.
  • Joseph Ratcliff, 29, of Grayson, on or about December 12, 2020, the defendant committed the offense of complicity to capital murder, by soliciting, commanding, or engaging in a conspiracy with another person to commit the offense, or aiding, counseling, or attempting to aid another person in the offense of the capital murder of John Waggoner, a Capital Offense. 
  • Megan R. Cook, 26, of Flatwoods, on or about August 1, 2017 through January 31, 2021, the defendant committed the offense of flagrant non-support by failing to support her minor child and accumulating an arrearage of $3,557.50, a Class D Felony. 
  • Leonard Danner, 48, of Grayson, on or about September 1, 2016 through November 30, 2020, the defendant committed the offense of flagrant non-support by failing to support his minor child and accumulating an arrearage of $33,571.54, a Class D Felony. 
  • Charles T. Windom, 49, of Paterson, NJ, on or about August 1, 2009 through January 31, 2021 the defendant committed the offense of flagrant non-support by failing to support his minor children and accumulating an arrearage of $10,167.02, a Class D Felony. 
  • Kayla M. Henderson, 29, of Grayson, on or about November 12, 2020, the defendant committed the offenses of buying or possession of drug paraphernalia, when she unlawfully possessed drug paraphernalia with the intent to use it for the purpose of introducing into the human body an illegal or controlled substance, a Class A Misdemeanor; trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a schedule one narcotic, heroin, a Class C Felony; trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a schedule one narcotic, over two grams of methamphetamine, a Class C Felony.
  • Blake D. Johnston, 29, of Olive Hill, on or about February 27, 2020, the defendant committed the offenses of trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a schedule one narcotic, heroin, a Class C Felony; trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a schedule one narcotic, over two grams of methamphetamine, a Class C Felony; trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a schedule one narcotic, fentanyl, a Class C Felony.
  • Candace Johnston, 35, of Olive Hill, on or about February 27, 2020, the defendant committed the offenses of trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a schedule one narcotic, heroin, a Class C Felony; trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a schedule one narcotic, over two grams of methamphetamine, a Class C Felony; trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a schedule one narcotic, fentanyl, a Class C Felony.
  • Samantha Lewis, 32, of Olive Hill, on or about October 29, 2020, the defendant committed the offenses of assault in the second degree by intentionally assaulting the victim with a dangerous instrument, causing him to suffer physical injury, a Class C Felony; burglary in the first degree by knowingly and unlawfully entering the dwelling of the victim with intent to commit a crime and in the immediate flight therefrom cause physical injury to the victim, a Class B Felony; committed the violation of Criminal Trespass, third degree, by knowingly entering or remaining unlawfully upon a premises; disorderly conduct, second degree, when in a public place and with intent to cause public annoyance, she made unreasonable noise causing others to be alarmed, a Class B Misdemeanor; menacing, by intentionally placing a person in reasonable apprehension of imminent physical injury, a Class B Misdemeanor; assault in the third degree, by intentionally assaulting an officer, a Class D Felony; resisting arrest, by using physical force against a peace officer who was arresting Lewis, a Class A Misdemeanor; theft by unlawful taking, under $500, by unlawfully taking items belonging two a second victim with intent to permanently deprive the victim of her property, a Class A Misdemeanor; criminal mischief third degree, by intentionally damaging property belonging to the second victim, a Class B Misdemeanor.
  • Ronnie E. Littleton, 34, of Olive Hill, on or about November 12, 2020, the defendant committed the offenses of driving with a suspended license, a Class B Misdemeanor; possession of drug paraphernalia, a Class A Misdemeanor; trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a schedule one narcotic, heroin, a Class C Felony; trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a schedule one narcotic, over two grams of methamphetamine, a Class C Felony.
  • Kristopher Mackey, 27, of Rush, on or about January 7, 2020 through December 3, 2020, the defendant committed the offenses of criminal abuse, first degree, when he intentionally abused a child, whom he has actual custody of, causing cruel punishment, torture, and physical injury to the victim, who is less than 12 years old, a Class C Felony; criminal abuse, first degree, when he intentionally abused a second child, whom he has actual custody of, causing cruel punishment, torture, and physical injury to the victim, who is less than 12 years old, a Class C Felony. 
  • Shanna Mackey, 39, of Rush, on or about January 7, 2020 through December 3, 2020, the defendant committed the offenses of criminal abuse, first degree, when she intentionally abused a child, whom she has actual custody of, causing cruel punishment, torture, and physical injury to the victim, who is less than 12 years old, a Class C Felony; criminal abuse, first degree, when she intentionally abused a second child, whom she has actual custody of, causing cruel punishment, torture, and physical injury to the victim, who is less than 12 years old, a Class C Felony.
  • David A McDavid, 65, of West Liberty, on or about December 7, 2020, the defendant committed the offenses of wanton endangerment, first degree, under circumstances manifesting extreme indifference to the value of human life, he wantonly engaged in conduct which created a substantial danger or death or serious physical injury to another, a Class D Felony; wanton endangerment, first degree, under circumstances manifesting extreme indifference to the value of human life, he wantonly engaged in conduct which created a substantial danger or death or serious physical injury to the child of the person endangered in the first count, a Class D Felony.
  • William Workman, 24, of Olive Hill, possession of a controlled substance, first degree, by knowingly and unlawfully possessing methamphetamine, a schedule one narcotic drug, a Class D Felony.
