Frankfort, Kentucky – Recently, House Bill 159, a measure by Representative Patrick Flannery of Olive Hill, was ceremonially signed into law by Governor Beshear. HB 159 grants immunity to “healthcare providers” from criminal charges relating to honest medical mistakes made while in the course of their duties with exceptions for gross negligence as well as wanton, willful, malicious, or intentional misconduct.
“The aim of the measure is to help those who care for us during our times of greatest need and to alleviate any stresses that may occur when they need to make necessary decisions,” Flannery said. “However, this still permits a path of legal recourse for patients in civil court.”
