The following indictments were returned by the Grand Jury of the Carter Circuit Court on December 3, 2021. An indictment is not a determination of guilt or innocence. It is simply a charge that an offense has been committed and indicates that a case is pending on the charges listed. All defendants have the presumption of innocence until found guilty in a court of law.
Though it is a part of the public record, the Carter County Times does not make a habit of printing the names of minor children or the victims of alleged crimes, except under exceptional circumstances.
- Russell Brown, 25, of Olive Hill, on or about November 3, 2021, through November 4, 2021, committed the offense of theft by unlawful taking, over $1,000, by taking property from Windstream valued at over $1,000 with intent to permanently deprive them of their property, a Class D Felony.
- Joseph Elam, 34, of Grayson, on or about November 2, 2021, committed the offense of receiving stolen property, over $1,000, by being in possession of property valued at over $1,000 belonging to another, knowing it to have been stolen, a Class D Felony.
- Joshua Marshall, 30, of Charleston, WV, on or about October 10, 2021, committed the offenses of possession of a controlled substance, first degree, first offense, when he possessed heroin, a schedule one narcotic, a Class D Felony; and possession of drug paraphernalia, when he unlawfully possessed drug paraphernalia with intent to use for the purpose of introducing into the human body illegal or controlled substances, a Class A Misdemeanor.
- Austin Miller, 27, of Hitchins, on or about November 2, 2021, committed the offense of receiving stolen property, over $1,000, by being in possession of property valued at over $1,000 belonging to another, knowing it to have been stolen, a Class D Felony.
- Ernie Valdez, 50, of Ontario, CA, on or about January 7, 2020, committed the offenses of possession of a controlled substance, first degree, first offense, when he possessed methamphetamine, a schedule one narcotic, a Class D Felony; possession of drug paraphernalia, when he unlawfully possessed drug paraphernalia with intent to use for the purpose of introducing into the human body illegal or controlled substances, a Class A Misdemeanor; and operating a motor vehicle under the influence, first offense, by operating a motor vehicle on a public roadway while intoxicated, a Class B Misdemeanor.
- Regina Whisman, 41, of Clay, on or about September 12, 2021, committed the offenses of possession of a controlled substance, first degree, first offense, when she possessed heroin, a schedule one narcotic, a Class D Felony; and operating a motor vehicle under the influence, first offense, by operating a motor vehicle on a public roadway while intoxicated, a Class B Misdemeanor.
- Leslie Whitaker, 35, of Grayson, on or about May 20, 2021, committed the offenses of trafficking in a controlled substance, first degree, first offense, by distributing, dispensing, selling, transferring, or possessing with intent to distribute, dispense, or sell fentanyl, a Class C Felony; with an enhancement for being an persistent felony offender, first degree, by committing the felonious act set forth in the indictment while being convicted of two prior felonies.
