The following indictments were returned by the Grand Jury of the Carter Circuit Court on December 8, 2022. An indictment is not a determination of guilt or innocence. It is simply a charge that an offense has been committed and indicates that a case is pending on the charges listed. All defendants have the presumption of innocence until found guilty in a court of law.
Though it is a part of the public record, the Carter County Times does not make a habit of printing the names of minor children or the victims of alleged crimes, except under exceptional circumstances.
- Russell Barker, 41, of Olive Hill, on or about October 22, 2022, committed the offenses of fleeing and evading police, first degree, motor vehicle, when with intent to elude he disregarded an officer’s directions to stop, creating a substantial risk of serious physical injury or death to the officers, a Class D Felony; reckless driving, by failing to operate his vehicle in a careful manner, with regard to the safety and convenience of pedestrians and other vehicles on the road, a violation; failure to maintain required insurance, first offense, by driving a motor vehicle on a public roadway without valid insurance in effect on the vehicle, a Class B Misdemeanor; wanton endangerment, first degree, police officer, by wantonly engaging in conduct which created a substantial danger of death or serious physical injury to an officer, a Class D Felony; trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a Schedule II narcotic, by distributing, or possessing with intent to distribute two or more grams of methamphetamine, a Class C Felony; trafficking in a controlled substance, first degree, first offense, by distributing, or possessing with intent to distribute, fentanyl, a Schedule II drug, a Class C Felony; possession of drug paraphernalia, a Class A Misdemeanor; trafficking in marijuana, less than eight ounces, first offense, a Class A Misdemeanor; trafficking in a controlled substance, first degree, first offense, drug unspecified, by distributing or possessing with intent to distribute more than 20 dosage units of a Schedule IV controlled substance, a Class A Misdemeanor; two counts of tampering with physical evidence, by throwing or tossing physical evidence which he believed would be in an official proceeding, each a Class D Felony; fleeing and evading police, second degree, on foot, when with intent to elude he disregarded an officer’s directions to stop, creating a substantial risk of physical injury to the officer, a Class A Misdemeanor; and possession of a controlled substance, second degree, by knowingly and unlawfully possessing a buprenorphine film, a Class A Misdemeanor.
- Michael Cooper, 43, of Vienna, WV, through September 30, 2022, committed the offense of flagrant non-support by failing to support his minor children, and accumulating an arrearage of $14,790.00, a Class D Felony.
- Willie Greenhill, 35, of Olive Hill, on or about July 21, 2019, committed the offense of receiving stolen property valued at more than $1,000 but less than $10,000 by being in possession of a purple Yamaha Motorcycle, Model V-Star, belonging to another and knowing it to be stolen, a Class D Felony.
- Parish Hamm, 28, of Morehead, on or about October 28, 2022, committed the offense of escape, second degree, by failing to return from furlough to the Carter County Detention Center while being charged with a felony offense, a Class D Felony; with an enhancement for committing the offense of being a persistent felony offender, second degree, by committing the felonious acts set forth in this indictment while being convicted of a prior felony.
- Robert Henderson, 31, of Olive Hill, through October 31, 2022, committed the offense of flagrant non-support by failing to support his minor children, and accumulating an arrearage of $5,863.67, a Class D Felony.
- Derrick Jenkins, 34, of Olive Hill, through October 31, 2022, committed the offense of flagrant non-support by failing to support his minor child, and accumulating an arrearage of $9,950.73, a Class D Felony.
- Danny Lawhorn, 50, of Olive Hill, through October 31, 2022, committed the offense of flagrant non-support by failing to support his minor child, and accumulating an arrearage of $2,615.75, a Class D Felony.
- Davina Middleton, 43, of Olive Hill, on or about November 16, 2022, committed the offense of possession of a controlled substance, first degree, first offense, when she possessed methamphetamine, a Schedule II narcotic, a Class D Felony.
- Lisa Sallie, 58, of Grayson, on or about November 10, 2022, committed the offense of unlawful transaction with a minor, second degree, by knowingly giving an illegal controlled substance to a minor, a Class D Felony; and possession of a controlled substance, first degree, first offense, when she possessed methamphetamine, a Schedule II narcotic, a Class D Felony.
- Chris Smith, 46, of Olive Hill, through October 31, 2022, committed the offense of flagrant non-support
- by failing to support his minor child, and accumulating an arrearage of $3,097.50, a Class D Felony.
- Shandon B. Wiler, 25, of Grayson, on or about August, 2022, committed the offense of sodomy, first degree, by having deviant sexual intercourse with a minor female, by forcible compulsion, a Class B Felony; on or about June – September, 2022, committed the offenses of procuring or promoting the use of a minor by electronic means, by knowingly communicating with a minor child, via electronic means, to induce the minor child to engage in sexual or other prohibited activities, a Class D Felony; and sexual abuse, first degree, while being 21 years old or more, subjected a minor less than 16 years of age to sexual contact and, being a person in a position of authority or position of special trust, as defined in KRS 532.045, he – regardless of his age – subjected a minor less than 18 years of age, with whom he comes into contact as a result of that position, to sexual contact, a Class D Felony.
