Indictments: 8/18/23

The following indictments were returned by the Grand Jury of the Carter Circuit Court on September 8, 2023. An indictment is not a determination of guilt or innocence. It is simply a charge that an offense has been committed and indicates that a case is pending on the charges listed. All defendants have the presumption of innocence until found guilty in a court of law.

Though it is a part of the public record, the Carter County Times does not make a habit of printing the names of minor children or the victims of alleged crimes, except under exceptional circumstances.

  • Tommy Garris, 34, of Denton, on or about July 8, 2023, committed the offenses of possession of a firearm by convicted felon by having possession of a black Remmington 770 rifle, while having a prior conviction, a Class D Felony; resisting arrest, by using force against  a peace officer who was effectuating an arrest, a Class A Misdemeanor; menacing, by intentionally placing another person in reasonable apprehension of imminent physical injury; a Class B Misdemeanor; disorderly conduct, second degree, when he appeared in a public place with the intent to cause public inconvenience, annoyance, alarm, or wantonly creating a risk thereof by engaging in a threatening and violent behavior, a Class B Misdemeanor;  two counts intimidating a participant in the legal process, by threatening a peace officer concerning his custody case, with physical harm, in an attempt to influence them to avoid the court proceedings, a Class D Felony; terroristic threatening, third degree, by threatening to commit a crime against another likely to cause serious physical injury to them, a Class A Misdemeanor; assault, fourth degree, domestic violence, minor injury, by intentionally causing physical injury to another, a Class A Misdemeanor. 
  • Joseph Smith, Jr., 50, of Greenup, on or about June 30, 2023, committed the offense of theft by unlawful taking of firearm by taking a firearm from someone with intent to permanently deprive them of their property, a Class D Felony. 
  • Joseph Boggs, 43, of Grayson, on or about August 7, 2023, committed the offenses of possession of a controlled substance, first degree, first offense when he possessed methamphetamine, a schedule two narcotic, a Class D Felony; drug paraphernalia, buy/possess, when he unlawfully possessed drug paraphernalia with the intent to use for the purpose of introducing into the human body illegally, a Class A Misdemeanor; public intoxication when he appeared in a public place manifestly under the influence of a controlled substance, or other intoxicating substance, excluding alcohol, to the degree that he may endanger himself, another person, or property; a Class B Misdemeanor. 
  • Dustin Burnett, 26, of Grayson, on or about February 18, 2022, committed the offenses of wanton endangerment, first degree, by wantonly engaging in conduct which created a substantial danger of death or serious physical injury to another, a Class D Felony; fleeing and evading police, first degree, motor vehicle, with intent to elude, disregarded officer’s directions to stop creating a substantial risk of serious physical injury or death to the officers, a Class D Felony; fleeing and evading police, first degree on foot, with intent to elude, disregarded officer’s directions to stop creating a substantial risk of serious physical injury or death to the officers, a Class D Felony; reckless driving, by failing to operate his vehicle in a careful manner, with regard to the safety and convenience of pedestrians and other vehicles on the roadway, a violation; failure of non-owner operator to maintain required insurance, first offense, by driving a motor vehicle without security on a motor vehicle on a public roadway without valid insurance in effect on the vehicle, a Class B Misdemeanor; no registration receipt by not having a registration receipt in his possession, a violation.
  • Aaron Kilgore, 49, of Olive Hill, on or about August 6, 2023, committed the offenses of operating a motor vehicle under the influence of a controlled substance, second offense within a ten-year period, by operating a motor vehicle on a public roadway while under the influence of drugs or controlled substance impairing driving ability, a Class B Misdemeanor; possession of a controlled substance, first degree, when he possessed fentanyl, a schedule two narcotic, a Class D Felony.
  • Joshua Lewis, 38, of Sandy Hook, on or about August 23, 2023, committed the offenses of rape, first degree, by having sexual intercourse with another person by forcible compulsion, a Class B Felony; sodomy, first degree, by having deviate sexual intercourse with another by forcible compulsion, a Class B Felony.
  • Stephen Ludwig, 32, of Grayson, on or about August 3, 2023, committed the offense of possession of a
  • controlled substance first degree, second offense when he possessed methamphetamine, a schedule two narcotic, a Class D Felony.
  • Dametric McGurie, 28, of La Grange, North Carolina, on or about August 11, 2023, committed the offense of assault in the first degree by intentionally assaulting another, shooting the victim in the abdomen, causing him to suffer serious physical injury, a Class B Felony.
  • Austin Miller, 29, of Grayson, on or about August 3, 2023, committed the offenses of operating on suspended license, by operating a motor vehicle on a public roadway while having a suspended license, a Class B Misdemeanor; trafficking in a controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a schedule two narcotic, with intent to distribute, dispense, or sell less than or equal to two grams of methamphetamine, a Class C Felony. 
  • David Phillips, 36, of Olive Hill, on or about July 29, 2023, committed the offenses of possession of burglary tools by having possession of burglary tools in a duffle bag he was carrying (wire, stripping pliers, flashlight, large hatchet), a Class A Misdemeanor;  theft, by unlawful taking $1,000.00 < $10,000, by taking phone wires, with intent to permanently deprive the owners of property and services they provide, a Class D Felony; criminal mischief, first degree, by intentionally destroying property, causing more than $1,000.00 in damage, a Class D Felony; drug paraphernalia, buy/possess, when he unlawfully possessed drug paraphernalia with the intent to use for the purpose of introducing into the human body illegally, a Class A Misdemeanor.
  • Drew Zirkle, 35, of Grayson, on or about July 20, 2023, committed the offenses of possession of a controlled substance, first degree, carfentanil or fentanyl derivatives, when he possessed a schedule two narcotic, a Class D Felony; a Class D Felony; drug paraphernalia, buy/possess, when he unlawfully possessed drug paraphernalia with the intent to use for the purpose of introducing into the human body illegally, a Class A Misdemeanor.
