Indictments from July 24, 2020

The following indictments were returned by the Grand Jury of the Carter Circuit Court on July 24, 2020. An indictment is not a determination of guilt or innocence. It is simply a charge that an offense has been committed and indicates that a case is pending on the charges listed. All defendants have the presumption of innocence until found guilty in a court of law. 

Though it is a part of the public record, the Carter County Times does not make a habit of printing the names of minor children or the victims of alleged crimes, except under exceptional circumstances. 

  • Lonnie Bailey, 37, of Olive Hill, on or about May 3, possession of a controlled substance, first degree, first offense, methamphetamine, a schedule I narcotic, a Class D felony; leaving the scene of an accident by having an accident with an automobile and fleeing the scene without locating and notifying the owner of such property of the name, address, and registration number of the vehicle he was driving or leaving written notice of the same, or filing a report with local police, a Class A misdemeanor. 
  • Billy Barker, 43, of Olive Hill, on or about May 4, possession of a controlled substance, first degree, second offense, methamphetamine, a schedule I narcotic, while having a previous conviction for the same, a Class D felony; possession of drug paraphernalia, for unlawful possession of drug paraphernalia with intent to use for the purpose of introducing into the body illegal or controlled substances, a Class A misdemeanor.
  • Jessica Barker, 41, of Olive Hill, on or about May 1, theft by failure to make required disposition of property over $500, when she took money totaling over $500 belonging to others associated with Cosmic Center gym and failed to deliver it to the owners and/or dealt with the property as her own and failed to make the required payment or disposition, a Class D felony. 
  • Steven Binion, 24, of Olive Hill, on or about May 2 – 3, theft by unlawful taking over $500, by taking property valued at over $500 with intent to permanently deprive the owner of their property, a Class D felony. 
  • Steven Binion, 24, of Olive Hill, on or about May 4, burglary, third degree, by unlawfully entering a building with intent to commit a crime, a Class D felony. 
  • Dean Borders, 27, of Grayson, on or about February 5, theft by unlawful taking of a firearm, with intent to permanently deprive the owner of their property, a Class D felony; theft by unlawful taking under $500, by taking property valued at less that $500, with intent to permanently deprive the owner of their property, a Class A misdemeanor. 
  • Andy Bradley, 40, of Olive Hill, on or about February 15, burglary, third degree, by unlawfully entering a building with intent to commit a crime, a Class D felony; being a persistent felony offender, first degree, by committing the felonious act set forth in the indictment while being convicted of two prior felonies. 
  • Michael Cox, 50, of Grayson, on or about April 16, receiving stolen property over $500, a Class D felony. 
  • Scott Gildea, 60, of Grayson, on or about April 3, receiving stolen property over $500, a Class D felony; theft by unlawful taking under $500, by taking property valued at $300, with intent to permanently deprive the owner of their property, a Class A misdemeanor. 
  • Larry Hall, 42, of Grayson, on or about April 2, burglary in the second degree by knowingly and unlawfully entering a dwelling with intent to commit a crime, a Class C felony. 
  • Brittany Hamm, age unknown, of Olive Hill, on or about May 4, possession of a controlled substance, first degree, first offense, methamphetamine, a schedule I narcotic, a Class D felony; tampering with physical evidence by fabricating evidence, or offering physical evidence knowing it to be fabricated or altered, with intent that it be introduced in an official proceeding, a Class D felony. 
  • Gary Matthew Howerton, 34, of Olive Hill, on or about May 4, trafficking in a controlled substance, first degree, first offense, under 2 gram of methamphetamine, a Class D felony; receiving stolen property over $500, by being in possession of property valued at over $500, knowing it to have been stolen, a Class D felony; tampering with physical evidence by fabricating evidence, or offering physical evidence knowing it to be fabricated or altered, with intent that it be introduced in an official proceeding, a Class D felony; offense of being a persistent felony offender, second degree, by committing the felonious acts set forth in the indictment while being convicted of a prior felony. 
  • Gary Matthew Howerton, 34, of Olive Hill, on or about June 28, arson in the first degree by starting a fire in an occupied home with intent to destroy or damage the house, a Class A felony; criminal mischief first degree by intentionally destroying property and causing more than $1,000 damage, a Class D felony; kidnapping – adult, by unlawfully restraining Brittany Hamm, to accomplish the commission of a felony, or to inflict bodily injury or to terrorize the victim or another, or to use as a shield or hostage, a Class B felony; wanton endangerment, first degree, by wantonly engaging in conduct which created a substantial danger of death or serious injury to Brittany Hamm, a Class D felony; wanton endangerment, first degree, by wantonly engaging in conduct which created a substantial danger of death or serious physical injury to the victim, a Class D felony; assault fourth degree minor injury by intentionally causing physical injury to Brittany Hamm, a Class A misdemeanor; offense of being a persistent felony offender, second degree, by committing the felonious acts set forth in the indictment while being convicted of a prior felony. (Editor’s note, while we typically withhold the names of victims, in this indictment we have listed the name of one of the victims, to show a connection between that victim and the perpetrator because of the victim’s indictment on an incident occurring on or about May 4.) 
  • Adam Johns, 36, of Grayson, on or about June 27, burglary in the second degree by knowingly and unlawfully entering a dwelling with the intent to commit a crime, a Class C felony; offense of being a persistent felony offender, second degree, by committing the felonious acts set forth in the indictment while being convicted of a prior felony.
  • Adam Johns, 36, of Grayson, on or about June 30, possession of a controlled substance, first degree, first offense, heroin, a schedule I narcotic, Class D felony; unlawful possessing of drug paraphernalia with intent to use for the purpose of introducing into the body illegal or controlled substances, a Class A misdemeanor. 
  • Chad Kees, 42, of Olive Hill, on or about July 1, possession of a controlled substance, first degree, first offense, methamphetamine, a schedule I narcotic, Class D felony; possession of a controlled substance, third degree, by possessing a controlled substance classified as a schedule IV or V drug, Class A misdemeanor; unlawful possession of drug paraphernalia with intent to use for the purpose of introducing into the body illegal or controlled substances, Class A misdemeanor; possession of handgun by a convicted felon, Class C felony.
  • George Mauk, 44, of Grayson, on or about May 31, trafficking in controlled substance, first degree, first offense, 2 or more grams of methamphetamine, a schedule I narcotic, Class C felony; tampering with physical evidence by fabricating evidence, or offering physical evidence knowing it to be fabricated or altered, with intent that it be introduced in an official proceeding, Class D felony; unlawful possession of drug paraphernalia with intent to use for the purpose of introducing into the body illegal or controlled substances, Class A misdemeanor; persistent felony offender, first degree, by committing felonious acts set forth in the indictment while being convicted of two prior felonies. 
  • Jordan Patrick Ratcliff, 24, of Grayson, on or about May 12, trafficking in a controlled substance, first degree, first offense, heroin, Class C felony; trafficking in a controlled substance, first degree, first offense, under 2 grams of methamphetamine, a schedule I narcotic, Class D felony; trafficking in a controlled substance, first degree, first offense, drug unspecified, by possessing with intent to distribute, dispense, or sell more than 10 dosage units of a schedule I or II controlled substance, a Class C felony; unlawful possession of drug paraphernalia with intent to use for the purpose of introducing into the body illegal or controlled substances, Class A misdemeanor. 
  • Danielle Sparks, 33, of Sandy Hook, on or about May 12, burglary in the second degree, by knowingly and unlawfully entering a dwelling with intent to commit a crime, Class C felony. 
  • Harold Stafford, 59, of Olive Hill, on or about May 4, burglary third degree, by unlawfully entering a building with intent to commit a crime, Class D felony. 
  • Charles Stevens, 29, of Olive Hill, on or about April 8, possession of a controlled substance, first degree, first offense, methamphetamine, a schedule I narcotic, Class D felony; unlawful possession of drug paraphernalia with intent to use for the purpose of introducing into the body illegal or controlled substances, Class A misdemeanor.
  • James Stevens, 43, of Grayson, on or about April 3, receiving stolen property over $500, Class D felony; theft by unlawful taking, under $500, by taking property valued at $300 with intent to permanently deprive the owner of their property, class A misdemeanor.
