Indictments 4/23/21

The following indictments were returned by the Grand Jury of the Carter Circuit Court on April 23, 2021. An indictment is not a determination of guilt or innocence. It is simply a charge that an offense has been committed and indicates that a case is pending on the charges listed. All defendants have the presumption of innocence until found guilty in a court of law. 

Though it is a part of the public record, the Carter County Times does not make a habit of printing the names of minor children or the victims of alleged crimes, except under exceptional circumstances. 

  • Gavin Adkins, 22, of Sandy Hook, on or about March 24, 2021, committed the offense of unlawful transaction with a minor, first-degree, by inducing, assisting, or causing a juvenile less than 18 years of age to engage in illegal controlled substance activity involving controlled substances other than marijuana or salvia, a Class C Felony. 
  • Gerald Butler, 46, of Vanceburg, on or about February 20, 2021, committed the offense of theft by unlawful taking, over $500, by taking property valued at over $500 with intent to permanently deprive them of their property, a Class D Felony. 
  • Eric Carpenter, 36, of Warren, Ohio, on or about March 1, 2010 through March 31, 2021, committed the offense of flagrant non-support by failing to support his minor child, and accumulating an arrearage of $3,511.52, a Class D Felony. 
  • Kevin Caskey, 34, of Grayson, on or about February 27, 2021, committed the offenses of operating a motor vehicle under the influence, first offense, by operating a motor vehicle on a public roadway while intoxicated, a Class B Misdemeanor; and possession of a controlled substance, first-degree, first offense, drug unspecified, a Class D Felony. 
  • Margaret Crider, 49, of Olive Hill, on or about March 12, 2021, committed the offenses of possession of a controlled substance, first-degree, first offense, when he possessed methamphetamine, a schedule one narcotic, a Class D Felony; possession of a controlled substance, first-degree, first offense, when he possessed heroin, a schedule one narcotic, a Class D Felony; and possession of drug paraphernalia, when he unlawfully possessed drug paraphernalia with the intent to use it for the purpose of introducing into the human body an illegal or controlled substance, a Class A Misdemeanor.
  • Jason Cushard, 36, of Vanceburg, on or about January 15, 2021, committed the offense of operating a motor vehicle under the influence, first offense, aggravating circumstance, by operating a motor vehicle on a public roadway while intoxicated under aggravating circumstances, a Class B Misdemeanor; on or about March 15, 2021, committed the offense of operating on a suspended operator’s license, by operating a motor vehicle on a public roadway while having a suspended license, a Class B Misdemeanor; on or about March 2, 2021, committed the offense of receiving stolen property over $10,000, by being in possession of property belonging to another valued at over $10,000, knowing it to have been stolen, a Class C Felony; on or about February 7, 2021, committed the offense of possession of marijuana, a Class B Misdemeanor.
  • Kermit Duncan, 52, of Lexington, on or about March 10, 2021, committed the offenses of operating on a suspended operator’s license, by operating a motor vehicle on a public roadway while having a suspended license, a Class B Misdemeanor; operating a motor vehicle under the influence, first offense, by operating a motor vehicle on a public roadway while intoxicated, a Class B Misdemeanor; possession of a controlled substance, first-degree, first offense, when he possessed methamphetamine, a schedule one narcotic, a Class D Felony; possession of a controlled substance, first-degree, first offense, when he possessed heroin, a schedule one narcotic, a Class D Felony; and possession of marijuana, a Class B Misdemeanor. 
  • Mandy Elliott, 43, of Grayson, on or about March 6, 2021, committed the offenses of operating a motor vehicle under the influence, first offense, by operating a motor vehicle on a public roadway while intoxicated, a Class B Misdemeanor; and possession of a controlled substance, first-degree, first offense, when he possessed heroin, a schedule one narcotic, a Class D Felony. 
  • Casey Flaugher, 36, of Rush, on or about April 2, 2021, committed the offense of theft by unlawful taking, firearm, by taking a firearm from the victim with intent to permanently deprive them of their property, a Class D Felony. 
  • Jeremy Green, 31, of Grayson, on or about February 10, 2021 through March 24, 2021, committed the offense of fraudulent use of a credit card, over $500 and less than $10,000, by making unauthorized withdrawals or transactions on a debit/credit card belonging to another with purchases being a total amount over $500, a Class D Felony. 
  • James Griffith III, 23, of Mansfield, Ohio, on or about February 14, 2021, committed the offense of theft by unlawful taking, over $500, by taking property from the victim, valued at over $500 with intent to permanently deprive them of their property, a Class D Felony. 
  • Eric Hall, 42, of Olive Hill, on or about March 12, 2021, committed the offenses of possession of a controlled substance, first-degree, first offense, when he possessed methamphetamine, a schedule one narcotic, a Class D Felony; possession of a controlled substance, first-degree, first offense, when he possessed heroin, a schedule one narcotic, a Class D Felony; and possession of drug paraphernalia, when he unlawfully possessed drug paraphernalia with the intent to use it for the purpose of introducing into the human body an illegal or controlled substance, a Class A Misdemeanor.
  • Christopher Halley, 41, of Rush, on or about February 15, 2021, committed the offense of receiving stolen property over $500, by being in possession of property valued at over $500 belonging to another, knowing it to have been stolen, a Class D Felony. 
  • Brandon Hicks, 27, of Olive Hill, on or about March 17, 2021, committed the offense of possession of a controlled substance, first-degree, first offense, when he possessed methamphetamine, a schedule one narcotic, a Class D Felony. 
  • Zachary Jones, 34, of Webbville, on or about February 20, 2021, committed the offense of arson in the third-degree, by wantonly causing destruction or damage to a building of another by intentionally starting a fire or causing an explosion, a Class D Felony. 
  • Terry Jordan, 40, of Grayson, on or about March 19, 2021, committed the offenses of burglary third degree, by unlawfully entering a building belonging to another with intent to commit a crime, a Class D Felony; criminal mischief third degree, by intentionally or wantonly defacing, damaging, or destroying property. 
  • Caleb Keaser, 25, of Newark, Ohio, on or about February 22, committed the offenses of theft of identity when he knowingly possessed and used another’s identifying information with the intent to represent himself as the other and deprive the other person of their property, a Class D Felony; and fraudulent used of a credit card less than $500, by making unauthorized withdrawals or transactions on a debit or credit card belonging to another with such purchases being a total amount under $500, a Class A Misdemeanor. 
  • Sheldon McGuire, of Olive Hill, on or about January 23, 2018 through March 31, 2021, committed the offense of flagrant non-support by failing to support his minor children and accumulating an arrearage of $17,884.15, a Class D Felony.
  • Jeffery Newell, 39, of Olive Hill, on or about March 30, 2021, committed the offenses of receiving stolen property over $500, by being in possession of property valued at over $500 belonging to another, knowing it to have been stolen, a Class D Felony; trafficking in a controlled substance, first-degree, first offense, two or more grams of methamphetamine, by knowingly and unlawfully trafficking in a Schedule I or II narcotic, a Class C Felony. 
  • James Nolen, 50, of Olive Hill, on or about March 22, 2017 through March 31, 2021, committed the offense of flagrant non-support by failing to support his minor children, and accumulating an arrearage of $11,455.38, a Class D Felony. 
  • Darryl Owens, 55, of Olive Hill, on or about March 17, 2020, committed the offense of possession of a controlled substance, first-degree, first offense, when he possessed methamphetamine, a schedule one narcotic, a Class D Felony. 
  • Charles Paulsell, 36, of Grayson, on or about September 1, 2018 through March 31, 2021, committed the offense of flagrant non-support by failing to support his minor child, and accumulating an arrearage of $7,626.00, a Class D Felony.
  • Michael Salyers, 35, of Rush, on or about January 1, 2017 through March 31, 2021, committed the offense of flagrant non-support by failing to support his minor children, and accumulating an arrearage of $12,308.86, a Class D Felony.
  • Derek Shumate, 38, of Vanceburg, on or about March 21, 2021, committed the offenses of DUI while on a suspended license, third offense aggravating circumstances, by operating a motor vehicle while under the influence of drugs or alcohol and having a suspended license for a prior DUI with two convictions for the same within the last ten years under aggravating circumstances, a Class D Felony; operating a motor vehicle under the influence, second offense, by operating a motor vehicle on a public roadway while intoxicated while having a prior conviction for DUI in the last ten years, a Class A Misdemeanor; and receiving stolen property over $500, by being in possession of property valued at over $500 belonging to another, knowing it to have been stolen, a Class D Felony. 
  • Christopher Smith, 38, of Grayson, on or about April 6, 2021, committed the offenses of operating a motor vehicle under the influence, second offense aggravating circumstances, by operating a motor vehicle on a public roadway while intoxicated while having a prior conviction for DUI in the last ten years under aggravating circumstances, a Class A Misdemeanor; possession of drug paraphernalia when he unlawfully possessed drug paraphernalia with the intent to use it for the purpose of introducing into the human body an illegal or controlled substance, a Class A Misdemeanor; trafficking in a controlled substance, first-degree, first offense, heroin, by knowingly and unlawfully trafficking in a Schedule I narcotic, a Class C Felony; and driving on a DUI suspended license, first offense, by operating a motor vehicle while having a suspended license for a prior DUI within the last ten years, a Class B Misdemeanor. 
  • Jesse Stephens, 30, of Olive Hill, on or about March 15, 2021, committed the offenses of operating on a suspended operator’s license, by operating a motor vehicle on a public roadway while having a suspended license, a Class B Misdemeanor; operating a motor vehicle under the influence, first offense, by operating a motor vehicle on a public roadway while intoxicated, a Class B Misdemeanor; and possession of a controlled substance, first-degree, first offense, when he possessed methamphetamine, a Schedule I narcotic, a Class D Felony. 
  • John Summers, 45, of Charleston, WV, on or about March 15, 2021, committed the offense of obscuring the identity of a machine over $500, but under $10,000, by intentionally removing, defacing, covering, destroying, altering, or obscuring a manufacturer’s serial number or any other distinguishing identification number or mark with intent to render it or other property unidentifiable, a Class D Felony. 
  • Brandon Suttles, 30, of Olive Hill, on or about March 1, 2016 through March 31, 2021, committed the offense of flagrant non-support by failing to support his minor child and accumulating an arrearage of $9,331.49, a Class D Felony. 
  • Eric Swanigan, 36, of Olive Hill, on or about March 12, 2021, committed the offenses of possession of a controlled substance, first-degree, first offense, when he possessed methamphetamine, a Schedule I narcotic, a Class D Felony; possession of a controlled substance, first-degree, first offense, when he possessed heroin, a Schedule I narcotic, a Class D Felony; and possession of drug paraphernalia, when he unlawfully possessed drug paraphernalia with the intent to use it for the purpose of introducing into the human body an illegal or controlled substance, a Class A Misdemeanor. 
  • Chalmer Wallace, 33, of Morehead, on or about March 30, 2021, committed the offenses of receiving stolen property over $500, by being in possession of property valued at over $500 belonging to another, knowing it to have been stolen, a Class D Felony; and trafficking in a controlled substance, first-degree, first offense, two or more grams of methamphetamine, by knowingly and unlawfully trafficking in a Schedule I or II narcotic, a Class C Felony.
  • Olivia Williams, 29, of Grayson, on or about August 1, 2016 through March 31, 2021, committed the offense of flagrant non-support by failing to support her minor children, and accumulating an arrearage of $16,053.79, a Class D Felony. 
  • Derek Wright, 20, of Grayson, on or about March 11, 2021, committed the offenses of receiving stolen property over $500, by being in possession of property valued at over $500 belonging to another, knowing it to have been stolen, a Class D Felony. 
  • Bryan L. Sheeter, 38, of Grayson, on or about February 20, 2021, committed the offense of strangulation, first-degree, by intentionally impeding the normal breathing or circulation of the blood of the victim, applying pressure on their throat or neck, or blocking their nose or mouth without consent, a Class C Felony. 
  • Keith Tyler McClain, 31, of Grayson, on or about August 2019 through January 2020, committed the offense of rape, first-degree, by having sexual intercourse with their victim by forcible compulsion, a Class B Felony.
