Indictments: 10/25/22

The following indictments were returned by the Grand Jury of the Carter Circuit Court on October 25, 2022. An indictment is not a determination of guilt or innocence. It is simply a charge that an offense has been committed and indicates that a case is pending on the charges listed. All defendants have the presumption of innocence until found guilty in a court of law.

Though it is a part of the public record, the Carter County Times does not make a habit of printing the names of minor children or the victims of alleged crimes, except under exceptional circumstances.

  • Stacy Wagoner, 33, of Grayson, on or about December 11, 2021, committed the offense of promoting contraband, first degree, by knowingly and unlawfully introducing or possessing dangerous contraband, into/while being confined at the Carter County Detention Center, a Class D Felony.
  • Dana Bailey, 43, of Vanceburg, on or about August 28, 2022, committed the offense of possession of a controlled substance, first degree, first offense, when she possessed heroin/fentanyl, a Schedule I narcotic, a Class D Felony.
  • Billy Binion, 41, of Olive Hill, on or about September 9, 2022, committed the offenses of fleeing and evading police, first degree on foot, when with the intent to elude, he disregarded an officer’s directions to stop, creating a substantial risk of serious physical injury or death to the officers, a Class D Felony; resisting arrest, by using physical force against peace officers who were effectuating an arrest, a Class A Misdemeanor; and criminal mischief, third degree, by intentionally or wantonly damaging or destroying the uniform of an officer, a Class B Misdemeanor.
  • Jacob Colley, 20, of Grayson, on or about August 27, 2022, committed the offenses of no operator’s license/moped license, by operating a motor vehicle on a public roadway without an operator’s license, a Class B Misdemeanor; failure to produce an insurance card, by failing to produce an electronic or paper format of his proof of insurance coverage to an officer, a Violation; no/expired registration receipt, by having an expired registration receipt, a Violation; operating a motor vehicle under the influence of a substance, first offense, by operating a motor vehicle on a public roadway while under the influence of drugs, a Class B Misdemeanor; trafficking in controlled substance, first degree, first offense, by knowingly and unlawfully trafficking in a controlled substance, by distributing, dispensing, selling, transferring, or possession with intent to distribute, dispense or sell heroin, a Schedule I narcotic, a Class C Felony; possession of a controlled substance, first degree, first offense, when he possessed methamphetamine, a Schedule II narcotic, a Class D Felony; and possession of a controlled substance, third degree, when he possessed an unspecified drug, a Schedule IV or Schedule V controlled substance, a Class A Misdemeanor.
  • Joseph Kouns, 34, of Grayson, on or about June 7, 2021, committed the offenses of escape, second degree, by failing to self-surrender to the Carter County Detention Center, while being charged with a felony offense, a Class D Felony; and bail jumping, first degree, by failing to self-surrender to the Carter County Detention Center as part of his plea agreement, while being charged with a felony offense, a Class D Felony.
  • Chasity Roe, 39, of Grayson, on or about December 15, 2021, committed the offenses of criminal possession of a forged instrument, second degree, by knowingly possessing a forged check, with the intent to defraud and deceive, using the check from East Side Church of Christ in Grayson, Kentucky, a Class D Felony; criminal possession of a forged instrument, second degree, by knowingly possessing a forged check, with the intent to defraud and deceive, using the check from East Side Church of Christ in Grayson, Kentucky, a Class D Felony; on or about February 18, committed the offense of criminal possession of a forged instrument , second degree, by knowingly possessing a forged check, with the intent to defraud and deceive, using the check from East Side Church of Christ in Grayson, Kentucky, a Class D Felony; also on or about February 28, 2022, committed the offense of criminal possession of a forged instrument, second degree, by knowingly possessing a forged check, with the intent to defraud and deceive, using the check from East Side Church of Christ in Grayson, Kentucky, a Class D Felony.
  • Shelly Sexton, 32, of Grayson, on or about August 27, 2022, committed the offenses of possession of a controlled substance, first degree, first offense, when she possessed heroin, a Schedule I narcotic, a Class D Felony; and possession of marijuana, by knowingly and unlawfully possessing marijuana, a Class B Misdemeanor.
