Indictments: 4/21/23

The following indictments were returned by the Grand Jury of the Carter Circuit Court on April 21, 2023. An indictment is not a determination of guilt or innocence. It is simply a charge that an offense has been committed and indicates that a case is pending on the charges listed. All defendants have the presumption of innocence until found guilty in a court of law.

Though it is a part of the public record, the Carter County Times does not make a habit of printing the names of minor children or the victims of alleged crimes, except under exceptional circumstances.

  • Reba Click, 36, of Olive Hill, on or about February 2, 2023, committed the offenses of operating on a suspended operator’s license, by operating a motor vehicle on a public roadway while have a suspended license, a Class B Misdemeanor; and operating a motor vehicle under the influence of a substance, fourth or greater offense, by operating a motor vehicle on a public roadway while under the influence of drugs, for a fourth subsequent offense within a ten year period, a Class D Felony.
  • James Estep, 40, of Grayson, on or about March 23, 2023, committed the offenses of operating a motor vehicle under the influence, first offense, by operating a motor vehicle on a public roadway while under the influence of drug, a Class B Misdemeanor; no registration receipt, a violation; failure to produce an insurance card, a violation; possession of drug paraphernalia, a Class A Misdemeanor; aggravated trafficking in a controlled substance, by knowingly and unlawfully trafficking 10 grams or more of carfentanil or fentanyl derivatives, under aggravating circumstances, a Class B Felony; and first degree trafficking in a controlled substance, first offense, by knowingly and unlawfully trafficking in a schedule one narcotic, heroin, a Class C Felony.
  • Dylan Evans, 27, of Grayson, through March 1, 2023, committed the offense of flagrant non-support by failing to support his minor child and accumulating an arrearage of $15,990.00, a Class D Felony.
  • Larissa Evans, 30, of Ashland, through March 31, 2023, committed the offense of flagrant non-support, by failing to support her minor child and accumulating an arrearage of $3,697.40, a Class D Felony.
  • Lewis Gollihue, 47, of Ashland, through March 31, 2023, committed the offense of flagrant non-support, by failing to support his minor child and accumulating an arrearage of $18,350.50, a Class D Felony.
  • Chester Griffith, 74, of Grayson, between 2015 through 2021, committed the offense of sexual abuse, first degree, by having sexual contact and committing sexual acts with a juvenile female, a Class C Felony.
  • Barry Ison, 68, of Grayson, on or about February 25, 2023, committed the offense of trafficking in a controlled substance, first degree, first offense, drug unspecified, by knowingly and unlawfully trafficking in a schedule one or schedule two narcotic, by selling or possessing with intent to sell 10 or more dosage units, a Class C Felony.
  • Jerald Jackson, 41, of Grayson, on or about March 25, 2023, committed the offenses of possession of a controlled substance, first degree, second offense, when he possessed methamphetamine, a schedule two narcotic, a Class D Felony; and possession of drug paraphernalia, a Class A Misdemeanor.
  • Derrick Lucas, 35, of Morehead, on or about June 11, 2022, committed the offenses of possession of a controlled substance, first degree, first offense, when he possessed heroin, a schedule one narcotic, a Class D Felony; possession of a controlled substance, first degree, first offense, when he possessed methamphetamine, a schedule two narcotic, a Class D Felony; possession of a controlled substance, first degree, first offense, drug unspecified, when he possessed a schedule one or schedule two narcotic, a Class D Felony; and possession of drug paraphernalia, a Class A Misdemeanor.
  • Tamara Miller, 54, of Grayson, on or about March 1, 2023, committed the offenses of failure to maintain required insurance, second or greater offense, by driving a motor vehicle on a public roadway without valid insurance in effect two or more times within a ten year period, a Class A Misdemeanor; possession of drug paraphernalia, a Class A Misdemeanor; operating a motor vehicle under the influence of a substance, second offense, by operating a motor vehicle on a public roadway while under the influence of drugs, for the second time within a ten year period, a Class A Misdemeanor; reckless driving, by failing to operate her vehicle in a careful manner with regard to the safety and convenience of pedestrians and other vehicles in the roadway, a violation; operating a motor vehicle with an expired operator’s license, a Class B Misdemeanor; and possession of a controlled substance, first degree, first offense, when she possessed heroin, a schedule one narcotic, a Class D Felony.
  • Shannon Preston, 46, of Olive Hill, on or about March 19, 2023, committed the offense of possession of a controlled substance, first degree, first offense, when she possessed methamphetamine, a schedule two narcotic, a Class D Felony.
  • Dakota Smith, 37, of Jeffersonville, through March 31, 2023, committed the offense of flagrant non-
  • support by failing to support his minor child and accumulating an arrearage of $6,491.99, a Class D Felony.
  • Luther Smith, 56, of Olive Hill, on or about March 14, 2023, committed the offenses of operating on a suspended operator’s license, by operating a motor vehicle on a public roadway while having a suspended license, a Class B Misdemeanor; failure to maintain required registration plate, by driving a motor vehicle on a public roadway without valid registration plates in effect on the vehicle, a violation; failure to maintain required insurance, first offense, a Class B misdemeanor; fleeing and evading police, first degree, on foot, when with intent to elude, he disregarded an officer’s directions to stop, creating a substantial risk of serious physical injury or death to the officers, a Class D Felony; resisting arrest, by using physical force against a police officer who was effectuating an arrest, a Class A Misdemeanor; assault in the third degree, by injuring an officer of the Olive Hill Police Department, a Class D Felony; and criminal mischief, third degree, by intentionally or wantonly defacing, damaging, or destroying property, a Class A Misdemeanor.
  • Denise Spillman, 40, of Olive Hill, through March 31, 2023, committed the offense of flagrant non-support by failing to support her minor child and accumulating an arrearage of $15,337.31, a Class D Felony.
  • Denise Spillman, 40, of Olive Hill, through March 31, 2023, committed the offense of flagrant non-support by failing to support her minor children, and accumulating an arrearage of $34,935.89, a Class D Felony.
  • Denise Spillman, 40, of Olive Hill, through March 31, 2023, committed the offense of flagrant non-support by failing to support her minor child and accumulating an arrearage of $7,211.00, a Class D Felony.
  • Jeremy Stewart, 48, of Grayson, through March 31, 2023, committed the offense of flagrant non-support, by failing to support his minor children and accumulating an arrearage of $14,727.98, a Class D Felony.
  • Johnny Tolliver, 36, of Denton, on or about January 19, 2023, committed the offenses of assault in the second degree, by intentionally assaulting another causing him to suffer serious physical injury or with a deadly weapon or dangerous instrument and causing him to suffer physical injury, a Class C Felony; and criminal mischief, second degree, by intentionally or wantonly damaging property or tampering with property as to knowingly endanger property belonging to another causing a loss of $500 or more, a Class A Misdemeanor.
  • Josheph Wheeler, 24, of Maysville, on or about March 23, 2023, committed the offenses of fleeing or evading police, first degree, motor vehicle, when with intent to elude he disregarded an officer’s directions to stop, creating a substantial risk of serious physical injury or death to the officers, a Class D Felony; wanton endangerment, first degree, by wantonly engaging in conduct which created a substantial danger of death or serious physical injury to the “female passenger of his vehicle that was begging him to pull over and stop,” a Class D Felony; tampering with physical evidence, throwing a loaded 9 mm pistol out of the passenger side window, thus attempting to conceal evidence which he believed would be in an official proceeding, a Class D Felony; and possession of a firearm by a convicted felon, by having possession of a 9 mm pistol, while having a prior felony conviction, a Class C Felony; with an enhancement, for the offense of being a persistent felony offender, first degree, by committing the felonious acts set forth herein while being convicted of a prior felony.
