Indictments: 6/23/23

The following indictments were returned by the Grand Jury of the Carter Circuit Court on June 23, 2023. An indictment is not a determination of guilt or innocence. It is simply a charge that an offense has been committed and indicates that a case is pending on the charges listed. All defendants have the presumption of innocence until found guilty in a court of law.

Though it is a part of the public record, the Carter County Times does not make a habit of printing the names of minor children or the victims of alleged crimes, except under exceptional circumstances.

James Estep, 41, of Grayson, on or about March 23,2023, committed the offenses of operating a motor vehicle under the influence of a substance, first offense, by operating a motor vehicle on a public roadway while under the influence of drugs, a Class B Misdemeanor; no registration receipt by not having a registration receipt in his possession, a violation; failure to produce an insurance card, by failing to produce an electronic or paper format of his proof of insurance coverage, a violation; drug paraphernalia, buy/possess when he unlawfully possessed drug paraphernalia with the intent to use for the purpose of introducing into the human body illegally, a Class A Misdemeanor; trafficking in a controlled substance, 10 grams or more of carfentanil or fentanyl derivatives, aggravated, enhancement of penalty while in possession of a firearm at the time of commission of offense, by knowingly and unlawfully trafficking by distributing, dispensing, selling, transferring with intent to distribute or sell, a Class A Felony; trafficking in controlled substance, first degree, first offense, heroin, while possessing a firearm, a Class B Felony; possession of a handgun by convicted felon by having possession of a revolver pistol while having a prior felony conviction, a Class C Felony; possession of a handgun by convicted felon by having possession of a revolver pistol while having a prior felony conviction, a Class C Felony; possession of a handgun by convicted felon by having possession of a rifle while having a prior felony conviction, a Class C Felony; trafficking in controlled substance, first offense, first degree, two or more grams of methamphetamine, while possessing a firearm, a Class B Felony; receiving stolen property over $1,000.00 under $10,000.000 by being in possession of a Honda XR650 Series Motorcycle, belonging to another knowing it to be stolen, a Class D Felony; receiving stolen property over $1,000.00 under $10,000.00 by being in possession of a Honda CRF50F Motor Scooter, belonging to another knowing it to be stolen, a Class D Felony.

Kayla Carver, 30, of Olive Hill, for the period from September 1, 2021, and through May 31, 2023, committed the offense of flagrant non-support by failing to support her three minor children, a Class D Felony.

Ashley Cox, 35, of Olive Hill, on or about February 28, 2022 through August 14, 2022, committed the offense of theft by deception, cold checks over $1,000.00 but less than $10,000.00 by issuing or passing a check or similar sight order for the payment of money in the amount of $4,690.00, knowing that it would not be honored by the drawee to obtain property of services from the victim, a Class D Felony.

Travis Parsons, 44, of Sandy Hook, on or about February 20, 2022, committed the offense of theft by unlawful taking over $1,000.00 by taking two walnut logs valued at $1,500.00 with intent to permanently deprive another from their property, a Class D Felony.

Andrew Porter, 38, of Olive Hill, on or about June 3, 2023, committed the offenses of unlawful imprisonment, first degree, when he knowingly and unlawfully restrained a victim under circumstances, which exposed her to a risk of serious physical injury, a Class D Felony; assault, fourth degree, minor injury, by intentionally causing physical injury to victim, a misdemeanor; strangulation, first degree by intentionally impeding the normal breathing or circulation of the blood of victim by restricting her airways without consent, a Class C Felony.

Michael P’Simer, 49, of Olive Hill, on or about April 28 2023, committed the offenses of operating a motor vehicle under the influence of a substance, second offense, by operating a motor vehicle on a public roadway while under the influence of drugs, for a second offense within a ten year period, a Class A Misdemeanor; operating on suspended operator’s license, by operating a motor vehicle on a public roadway while having a suspended license, a Class B Misdemeanor; possession of a controlled substance, first degree, first offense, when he possessed heroin, a schedule one narcotic, a Class D Felony; drug paraphernalia, buy/possess when he unlawfully possessed drug paraphernalia with the intent to use for the purpose of introducing into the human body illegally, a Class A Misdemeanor.

Keith Ratcliff, 60, of Grayson, on or about November 25, 2023, committed the offense of sexual abuse, first degree, by having sexual contact with a female, by forcible compulsion, a Class D Felony.

Benjamin Stone, 36, of Grayson, on or about April 28, 2023, committed the offense of theft by unlawfultaking over $1,000.00 but under $10,000.00, by taking property valued at $5,000.00 with intent to permanently deprive the victim of their property, a Class D Felony.

Scott Vanlandingham, 49, of Grayson, for the period from July 1, 2011, and through April 30, 2023, committed the offense of flagrant non-support by failing to support his minor child, a Class D Felony.
