Judge Neice dismisses IPOs in Rodkey case

Parties will meet again in civil court proceedings

A property dispute between Buck Road neighbors, which has boiled over into recent fiscal court meetings related to the proposed removal of that road from the county road system, will continue in civil court. 

According to Cloyd “Corey” Rodkey, the parties are scheduled to meet again before Judge Rupert Wilhoit just prior to Thanksgiving for a pretrial conference. The date, however, is not yet reflected on the Kentucky Court of Justice docket.

Requests for interpersonal protective orders (IPOs) filed by Kaelyn Anderson, age 28, and Cynthia Anderson, age 67, against Cloyd Rodkey, age 54, were also dismissed by Family Court Judge Jennifer Neice on October 29. Neice, in her ruling, found that the filings from the Andersons, “(did) not meet the requirements for (an) IPO.” 

Kaelyn Anderson, in her IPO request, alleged that Rodkey was guilty of stalking. Cynthia Anderson, who told fiscal court that Rodkey would present himself nude when she attempted to enjoy outdoor spaces, alleged stalking and sexual assault in her filing. Neice dismissed the IPO requests without prejudice. This means that the Andersons could potentially file new requests if they have additional evidence of harassment or assault by the Rodkeys that the judge determined did meet the requirements for an IPO.

Correction and update: We misquoted Cloyd Rodkey about the case continuing in civil court and the pretrial conference. The online docket has been updated and now reflects that Rodkey is set to appear in pretrial conference before Judge Rupert Wilhoit in District Court on Wednesday, November 27, on a charge of fourth degree assault (no visible injury), as well as for arraignment on two counts of harassment – no physical contact, and single counts each of second degree criminal mischief, third degree criminal trespassing, and resisting arrest.
