Indictments: 5/19/23

The following indictments were returned by the Grand Jury of the Carter Circuit Court on May 19, 2023. An indictment is not a determination of guilt or innocence. It is simply a charge that an offense has been committed and indicates that a case is pending on the charges listed. All defendants have the presumption of innocence until found guilty in a court of law.

Though it is a part of the public record, the Carter County Times does not make a habit of printing the names of minor children or the victims of alleged crimes, except under exceptional circumstances.

  • Richard Bausano, 73, of Olive Hill, on or about April 20, 2023, committed the offense of assault in the third degree, by striking an officer at the Carter County Detention Center, a Class D Felony.
  • Joseph Boggs, 43, of Catlettsburg, on or about April 15, 2023, committed the offenses of no/expired registration by having an expired registration receipt, a violation; failure of owner to maintain required insurance, first offense, by driving a motor vehicle on a public roadway without valid insurance in effect, a Class B Misdemeanor; driving DUI on suspended license, second offense, by operating a motor vehicle on a public roadway on a suspended license, second offense within five years, a Class A Misdemeanor; drug paraphernalia, by unlawfully possessing paraphernalia with intent to use for the purpose of introducing into the human body, a Class A Misdemeanor; failure to register transfer of motor vehicle, by failing to initiate the transfer of registration on a motor vehicle within fifteen days of the transfer of ownership, a Class A Misdemeanor; possession of a controlled substance, first degree, second offense, when he possessed heroin, a schedule one narcotic, a Class D Felony; possession of marijuana by knowingly and unlawfully possessing marijuana, a Class B Misdemeanor.
  • Matilda Everman, 43, of Morehead, on or about April 17, 2023, committed the offense of burglary, third degree, by unlawfully entering a building with intent to commit a crime, a Class D Felony.
  • David Fink, 59, of Grayson, on or about January 21, 2023, committed the offenses of driving DUI on a suspended license, first offense, aggravating circumstance, by operating a motor vehicle on a public roadway while intoxicated on a suspended license, a Class A Misdemeanor; reckless driving, by failing to operate his vehicle in a careful manner, a violation; operating a vehicle under the influence of a substance, second offense, by operating a motor vehicle on a public roadway while under the influence of drugs, a Class A Misdemeanor; possession of a controlled substance, first degree, second offense, when he possessed methamphetamine, a schedule two narcotic, a Class D Felony; failure to surrendered revoked operator’s license, when he failed to surrender, upon demand, his operator’s license which has been suspended, canceled, or revoked, a Class B Misdemeanor. 
  • Alesia Moore, 61, of Grayson, on or about April 13, 2023, committed the offenses of promoting contraband in the first degree, by knowingly and unlawfully introducing or possessing dangerous contraband while being confined at the Carter County Detention Center, a Class D Felony; possession of a controlled substance, first degree, first offense, when she possessed methamphetamine, a schedule one narcotic, a Class D Felony.
  • Phillip Roar, 45, of Morehead, on or about April 17, 2023, committed the offense of burglary, third degree, by unlawfully entering a building with intent to commit a crime, a Class D Felony. 
  • Virginia Skaggs, 43, of Olive Hill, on or about February 21, 2023 through March 21, 2023, committed the offenses of theft by deception cold checks over $1000.00 but less than $10,000.00, when said defendant obtained the services of multiple different businesses and persons by deception, a Class D Felony; nine counts of criminal possession of a forged instrument, second degree, when defendant forged the signature of another individual on a check with the intent to defraud and deceive another, each a Class D Felony; nine counts of forgery second degree, when said defendant falsely completed a written instrument and signed the victim’s name to a check with the intent to defraud and deceive another, each a Class D Felony.
  • William Sloas, 52, of Grayson, on or about December 5, 2022, committed the offense of possession of a controlled substance, first degree, first offense, when he possessed methamphetamine, a schedule two narcotic, a Class D Felony. 
  • Christopher Trent, 50, of Grayson, on or about April 26, 2023, committed the offense of possession of a controlled substance, first degree, first offense, when he possessed methamphetamine, a schedule two narcotic, a Class D Felony. 
  • James Whitt, 38, of Ashland, on or about August 7, 2023, committed the offenses of wanton endangerment, first degree, by wantonly engaging in conduct which created a substantial danger of death or serious injury to another, a Class D Felony; strangulation, first degree by intentionally impeding the normal breathing or circulation of the blood of another by applying pressure on his/her throat or neck or blocking his/her nose or mouth without consent, a Class C Felony.
